General Terms and Conditions (GTC)

ARTICLE R.211-3

Subject to the exclusions set out in the third and fourth paragraphs of article L.211
7, all offers and sales of travel or holiday services must be accompanied by appropriate documents which comply with the rules set out in this section. In the case of the sale of air tickets or tickets for scheduled air travel not accompanied by services related to such travel, the seller shall issue the purchaser with one or more tickets for the entire journey, issued by the carrier or under its responsibility. In the case of transportation on demand, the name and address of the carrier, on whose behalf the tickets are issued, must be mentioned. Separate invoicing of the various elements of a tourist package does not exempt the seller from his obligations under the regulatory provisions of this section.

ARTICLE R.211-3-1

The exchange of pre-contractual information or the provision of contractual conditions is made in writing. They may be made by electronic means under the conditions of validity and exercise set out in articles 1369 1 to 1369 11 of the French Civil Code. The name or company name and address of the seller are mentioned, together with an indication of his registration in the register provided for in a of article L.141 3 or, where applicable, the name, address and indication of the registration of the federation or union mentioned in the second paragraph of article R.211 2.

ARTICLE R.211-4

Prior to the conclusion of the contract, the seller must provide the consumer with information on the prices, dates and other components of the services provided as part of the trip or stay, such as : The destination, means, characteristics and categories of transport used, the type of accommodation, its location, its level of comfort and its main characteristics, its certification and tourist classification in accordance with the regulations or customs of the host country, the catering services offered, the description of the itinerary in the case of a tour, the administrative and health formalities to be completed by nationals or citizens of another Member State of the European Union or of a State party to the Agreement on the European Economic Area, the visits, excursions and other services included in the package or which may be available at extra cost, the minimum or maximum group size required for the trip or holiday and, if the trip or holiday is subject to a minimum number of participants, the deadline for informing the consumer in the event of cancellation of the trip or holiday; this date may not be less than twenty-one days before departure; the amount or percentage of the price to be paid as a deposit on conclusion of the contract, and the schedule for payment of the balance; the terms and conditions for price revision as provided for in the contract in application of article R.211Contractual cancellation conditions; Cancellation conditions defined in articles R.2119, R.211 10 and R.211 11
Information concerning the optional subscription of an insurance contract covering the consequences of certain cases of cancellation or an assistance contract covering certain specific risks, in particular repatriation costs in the event of accident or illness. When the contract includes air transport services, the information, for each flight section, provided for in articles R.211 15 to R.211 18.

ARTICLE R.211-9

When, before the buyer's departure, the seller is obliged to make a modification to one of the essential elements of the contract, such as a significant price increase, and when the seller fails to comply with the obligation to provide information mentioned in article R.211 13 4, the purchaser may, without prejudice to any claims for compensation for damage suffered, and after having been informed by the seller by any means capable of producing an acknowledgement of receipt :
Either cancel the contract and obtain immediate reimbursement of the sums paid, without penalty; Or accept the modification or substitute trip proposed by the seller; an amendment to the contract specifying the modifications made is then approved in writing by the parties; any reduction in price is deducted from any sums still owed by the buyer and, if the payment already made by the latter exceeds the price of the modified service, the excess must be returned before the date of departure.

Terms and conditions of sale

All orders placed through ML Private Travel imply acceptance of the terms and conditions below.

Reservation procedure

The website presents the products and services of ML Private Travel. Prices vary according to the period chosen, the departure and return dates, the services and options selected and the age of the participants. All prices are quoted in euros. VAT is always included. In accordance with the VAT regime applicable to travel agents, invoices indicate the VAT collected on the services sold. The sending by the customer of a "non-binding quotation" does not bind ML Private Travel. A quotation corresponding to the chosen trip, the period as well as the number of participants and the chosen options will be sent to the customer. This quotation is valid for 48 hours, but is not binding on ML Private Travel. If the customer agrees to this quotation, the customer will receive a pro-forma invoice, and the booking conditions will be sent to the customer together with the general terms and conditions of sale. This booking procedure constitutes prior pre-contractual information as referred to in article R.211 4 of the French Tourism Code. It commits ML Private Travel , subject to the availability of the service and its accessories at the price indicated at the time of receipt of the deposit received from the customer, which is deemed authentic and equivalent to an agreement. Confirmation of availability must be received within 72 working hours of receipt of the reservation deposit. In the event that the service is no longer available, ML Private Travel will contact the customer to propose a replacement service which, if accepted by the customer, will be the subject of a new reservation form.
No reservation request can be taken into account by ML Private Travel without the customer's acceptance of these general terms and conditions of sale. The customer acknowledges that he/she has the capacity to enter into a contract, i.e. that he/she is of legal age and that he/she is not under the protection of a legal adult. The present general conditions of sale apply to the quotation/contract received by the customer and constitute the travel contract with the latter.
The special clauses appearing on the booking form may derogate from certain stipulations of the general conditions of sale and other stipulations herein. Any special conditions requested by the customer, drawn up and accepted by ML Private Travel, must appear on the booking form. Failing this, these special conditions will be deemed unwritten and will not be enforceable against the agency. Please note that the right of withdrawal provided for in article L.221 18 of the French Consumer Code in the case of distance selling does not apply to contracts for the sale of travel and holidays under articles L.221.2,5 and L.221 28, 12 of the same code. The customer can consult the general sales conditions, administrative and health formalities, weather information and insurance conditions on the website. The customer agrees to use the hypertext links provided to supply the said information. This information, together with the booking quote, constitutes the prior information referred to in articles R.211 4 of the French Tourism Code and the contract referred to in article R.211 6 of the same code.

Price

Prices are those of the selected tour operators and are subject to change without notice. Prices vary according to the period of the trip, the number of participants, their age or the airline. No dispute concerning the price of the trip can be considered after the contract has been signed.
The price includes the services described on the booking form, to the exclusion of all others, such as pre-departure and post-return services, personal expenses, costs incurred by the customer directly with service providers, services of any kind not included in the package, beverages not included with meals, including mineral water when drinking water is not available, excess baggage, telephone calls, tips, including mandatory tips in certain countries, pre- or post-transportation costs, cabin or single room supplements not included in the package, this list being non-exhaustive. The contractual price is the one fixed at the time of the final booking after confirmation of availability. It may be modified upwards or downwards to take account of variations in: the cost of transport, linked in particular to the cost of fuel, and exchange rates applied to the trip or stay in question in proportion to their share in the calculation of the price of the trip; fees and taxes relating to the services offered, such as landing, embarkation and disembarkation taxes in ports and airports, solidarity tax, fuel surcharges invoiced by airlines, coach operators or shipping companies. Exchange rates and reference indices used to establish prices vary according to the service provider. During the thirty days prior to the scheduled departure date, the contract price may not be increased. Air and airport taxes are subject to change at any time without notice. Collection and delivery charges are invoiced for the dispatch of travel documents when requested by the customer. Shipping costs are communicated to the customer at the time of the request and are invoiced in addition, except for e-mail shipments.

Payment

Payment of the price is conditional upon delivery of the travel documents to the buyer. The balance must be paid no later than 60 days before departure. For all bookings made less than 60 days before departure, full payment will be required.
Payment methods : Vacation vouchers are not accepted. Credit cards are accepted. International VISA cards and EUROCARD MASTERCARDS (except DINNERS and American Express) are accepted.) Cash and euro payments under €3,000 are accepted. Bank transfers are accepted. In the case of distance selling, payment by credit card is accepted. A secure link will be sent upon request. We remind you that under the provisions of article L.313 1 of the French penal code, the transmission of a bank card number without the authorization of its holder is punishable by 5 years' imprisonment and a fine of €381,122. Delivery of a cheque (except a bank cheque) does not discharge the debt until it has been debited. The receipt of a bank transfer must be confirmed by our bank in order to discharge the debt. If the reservation is made less than eight days before departure, payment must be received before 4 p.m. on the same day.

Insurance

ML Private Travel has selected a range of comprehensive and cancellation insurance products which are offered on an optional basis in accordance with the provisions of the French Tourism Code. ML Private Travel acts only as an agent for its client, who remains the sole contracting party with the insurance company in the event of subscription. Our advisors are at your disposal for any information you may require. The general and special insurance conditions are available on our website. In the event of cancellation, the insurance amount is never refundable.

Carnet de voyage

No travel book can be delivered until payment has been received. Travel books can be collected at the agency, by e-mail or at the airport. In the latter case, you will receive an airport notification by e-mail or fax with all the information you need to collect your travel documents from the service provider's counter. Depending on the circumstances and at the customer's request, travel books and documents can be delivered to the customer by CHRONOPOST or COLISSIMO, by registered mail with acknowledgement of receipt, by courier or by messenger service. Delivery charges will be indicated to the customer at the time of the delivery request and will be invoiced in addition. They are not refundable to the customer in the event of cancellation, once the delivery has been made. Under no circumstances can ML Private Travel be held responsible for the loss or
theft of travel documents handed over to a carrier or delivery service, which will remain solely responsible for the loss or theft of documents and travel books.

Cancellation or modification by the customer

The present cancellation conditions apply unless specific cancellation conditions are indicated on the booking form, particularly for river or sea cruises and end-of-year holidays. When the booking is definitive, any cancellation, whatever the cause, will incur the following charges:
More than 60 working days before departure: actual cancellation charges (GTC of the partners, which can be consulted on their respective websites) with a maximum fixed at the amount of the non-refundable deposit
Between 60 and 30 working days before departure: actual cancellation charges (GTC of the partners, which can be consulted on their respective websites)
Less than 30 working days and the departure date: actual cancellation charges (GTC of the partners, which can be consulted on their respective websites)
You are informed of the possibility of taking out insurance covering the financial consequences of cancellation for certain reasons. Although optional, it is strongly recommended that you take out such insurance.
Special flights will not be reimbursed in the event of cancellation, whatever the date, nor will any tickets issued bearing the words "non-refundable" or "non-changeable".
On certain dates, airlines are required to issue tickets in advance. In this case, cancellation fees may be as high as 100% of the ticket price.
All cancellation requests must be made by registered mail with acknowledgement of receipt or in writing.

Booking fees, last-minute fees, non-transportation fees and insurance are non-refundable. Written requests resulting in a change of departure city, destination, hotel, departure date, traveler's name (including spelling of surname or first name) or failure to comply with the payment schedule are considered cancellations and will incur the above cancellation charges
. We therefore strongly recommend that you check this information before returning the signed registration form. Any trip interrupted or cut short by the customer will not entitle him/her to any reimbursement, in particular for any outward or return airplane seat or any other service.
Modification fees: Any modification of the final registration form at the customer's initiative before departure may give rise to possible fees requested by the service provider, of which the customer will be informed before the modification is carried out. Requests for changes must be made by means of an amendment to the travel contract accepted by both parties, and will only be taken into account after payment of the announced charges. If a cancellation by one of the trip participants or a modification results in the allocation of a single room or cabin, the corresponding supplement will be invoiced to the customer and must be paid before departure. No refunds will be made for trips not taken or interrupted by the customer.

Assignment of contract

In accordance with the provisions of articles L.21111 and R.211 7 of the French Tourism Code, the customer may assign his contract, excluding insurance, to a third party. The request for assignment must be received by ML Private Travel in writing no later than 7 days before the start of the trip, and no later than 15 days for a cruise, giving the precise names and addresses of the assignee(s) and the trip participant(s), and proving that the latter meet the same conditions, including age, as the customer, in order to take part in the trip or stay and benefit from the proposed rates. Beforehand, the transferor or transferee will be held jointly and severally liable for payment of any modification costs incurred as a result of the transfer and invoiced by ML Private Travel's service providers at actual cost and on presentation of supporting documents. Insurance policies are non-refundable and non-transferable.

Air Transport

Flight times are not known to the travel agency when the customer registers. They are therefore not part of the contract. For technical and safety reasons, all airlines reserve the exceptional right to modify flight schedules. Such changes may not give rise to any compensation whatsoever, in accordance with the provisions of Article 19 of the Montreal Convention. Carriers' liability is limited by the terms and conditions of the contract of carriage, and in particular by the provisions of the Montreal Convention. In application of the provisions of article L.211 16 of the French Tourism Code, the liability incurred by ML Private Travel cannot be higher than that of the airline company.
It may happen that a no-show on a scheduled outbound flight results in the invalidation of the return flight ticket by the
airline company. In such cases, the customer is responsible for buying back the tickets if the no-show on the outbound flight is his or her own fault. Airlines reserve the right to refuse boarding to pregnant women if they consider that, due to the term of the pregnancy, there is a risk of premature delivery during transport. They also require, regardless of the date of pregnancy, that a medical certificate of good health and no contraindication to travel be produced at the time of boarding. This medical certificate must have been issued less than fifteen days before the departure date. Charter flight schedules are subject to the decisions of the French Civil Aviation Authority (Direction Générale de l'Aviation Civile), and may not be communicated until 48 hours prior to departure.
If your ticket is lost or stolen, you must report this to the police and the airline
, and purchase replacement tickets from the issuing airline at your own expense.
Luggage is transported free of charge up to the kilos mentioned in the travel contract, depending on the airline and ticket category, per seat occupant, excluding children under the age of two. The baggage allowance applies to one bag per person. Some airlines, particularly North American ones, systematically charge for hold baggage or cabin baggage, and the same airlines apply a baggage allowance of 10 kg. Beyond this, the airlines charge a weight supplement, which ML Private Travel cannot accept under any circumstances. Loss, damage or delayed delivery of baggage is an unfortunately frequent occurrence in air travel: make sure your baggage is correctly labelled, remove any labels from your previous trip and
place a copy of your identity card with your address and telephone number in your suitcase. We offer you optional insurance products to cover this type of risk, bearing in mind that, under international con ventions, airlines have only limited liability in the event of loss, delay or damage to baggage. We recommend that you do not carry valuables in checked baggage. If, however, you are obliged to do so, you should make a declaration of value to the airline at check-in and, if necessary, insure the cost. Children under two years of age do not have a seat. Unaccompanied children under the age of 15 are not accepted. The size of baggage allowed in the cabin varies from one airline to another. Generally speaking, the total dimensions (height + length + width) of baggage admitted in the cabin may not exceed 115 cm, and its weight may not exceed 5 kg. These dimensions and weights vary according to airline, route and aircraft type. Cabin baggage remains the responsibility of its owner. It is the passenger's responsibility to find out which items are forbidden in the
hold or in the cabin. The applicable regulations are indicated on your ticket or in your travel booklet. You are advised to read your travel documents carefully, and to consult the Direction Générale de l'Aviation Civile website: www.dgac.fr under "air passengers" "security". Any prohibited items may be confiscated by the authorities on boarding, and will not be returned. The list of airlines subject to bans or restrictions can be consulted at www.dg ac.fr.

Special flights

Flights may be direct with or without a stopover, or include a stopover with a change of aircraft. Timetables, flight routing, aircraft types, departure and arrival airports are given for information only, for both outward and return journeys. In the event of a change of airport, particularly in Paris (Orly / Roissy), the cost of shuttle, cab, bus, parking, transport, hotels, etc. is borne by the customer. Return flight schedules must be confirmed with the local correspondent 72 hours before departure. However, you may be asked to call back at a later date.
Special and charter flights are subject to the following conditions: Any seat booked on a special or charter flight and not used on the outward or return journey cannot be reimbursed, even in the event of a rescheduling. Cancellation of a seat on a special flight in favor of a scheduled flight entails full payment of the fare at the normal rate.

Formalities

French and European Union nationals must be in possession of sufficiently valid identity documents, as specified on the registration form and in the description of the service, including for children, and be up to date with the required vaccinations. Minors must be in possession of identity papers in their own name. Minors cannot be registered on their parents' passports, including Delphine passports. Minors must hold an individual passport. For minors accompanied by only one parent, the parent must be in possession of the family record book. If the minor is traveling with a third party, the latter must hold an authorization to leave the country. Please note that some cruise lines consider persons under 21 to be minors, who are not authorized to travel alone on board and must be accompanied by parents or adults over 25, whose cabin they must share and who assume all responsibility for them. Some cruise lines do not accept infants on board their ships for safety reasons. The information given on the registration form is intended for French and European Union nationals. Foreign nationals must comply with the various regulations in force and contact the consular authorities of the country or countries of destination, stopover or transit to find out about the administrative formalities to be completed for their trip, and must inform the Travel Agency accordingly. In any case, we advise you to consult the websites www.diplomatie.gouv.fr under the heading "advice to travellers" and www.action visas.com, which will provide you with all useful information on the countries to be visited and those of stopover or transit, the formalities required and the time needed to complete them. The completion of formalities is the customer's responsibility, as is the verification of the surnames and first names of all participants in the trip on the travel documents given to you on receipt. Similarly, verification of the validity of identity documents required for the trip is the responsibility of the customer and not of the travel agency. ML Private Travel cannot be held responsible for the consequences of denied boarding due to the customer's inability to present administrative or health documents required for travel, or to the expiry of such documents. Any person wishing to travel by air must have a valid identity document, including in France and the SCHENGEN area. You can consult www.service public.fr under "papiers". Anyone leaving or arriving in the European Union with at least €10,000 in cash must declare this amount to customs. Cash that has not been declared may be retained by customs in the event of an inspection, and legal action may be taken. In addition, the transport of perishable goods is regulated. Finally, purchases made abroad must be declared to French customs, and are taxed according to their value and country of origin: www.douane.gouv.fr. It is advisable to observe the usual rules of hygiene when traveling abroad, in particular by not drinking tap water, avoiding ice cubes, popsicles, raw or uncooked products, unpeeled fruit, protecting yourself against insect bites, avoiding touching animals and avoiding uncertified natural freshwater bathing areas. Some bathing areas can be dangerous, and it's a good idea to find out more. Travel time

This includes the day of departure (from the time you are called at the airport) and the day of your return journey (until the time you arrive at your destination airport). As a result, the dates of your stay correspond to the dates on which you are called at the airports on your outward and return journeys. These dates may not coincide with the date of arrival at the destination or with the date of arrival in France on the return journey, due to flight schedules, flight times or time differences. It is standard practice in international hotels to take possession of the room from 3 p.m. whatever the flight arrival time, and to vacate it before 11 a.m. whatever the return flight time. Under no circumstances may the customer deviate from this rule. Any room taken before 3 p.m. or returned after 11 a.m. is considered as a night consumed. The first and last days are devoted to transportation. If you would like to have a room for an extra half-day, we will make you an offer based on availability.

Services

When applicable, the first hotel service begins with breakfast on the second day and ends with breakfast on the last day, whether served at the hotel or in the event of an early morning departure at the airport or on the plane. When water and wine are included with meals, they are carafe water and not mineral water. The number of meals included in the package varies according to the formula chosen and the number of nights. The "All Inclusive" package includes all meals, non-alcoholic beverages and, more often than not, locally-produced alcoholic beverages. Full board starts with dinner on the first night and ends with breakfast on the last night, which can be provided at the airport or on the plane if you have an early flight. Half-board includes breakfast and one meal a day. It generally begins with breakfast following the first night or dinner preceding it. It ends with the breakfast following the last night, which may be offered at the airport or on the plane in the case of early schedules. In accordance with the provisions of the French Tourism Code, hotel categories are indicated according to local standards and the classification of the host country. They differ from French standards. Single rooms or cabins include a single bed; they are available in limited numbers and are subject to an additional charge. Double rooms are available with either two beds or one double bed. Triple and quadruple rooms are double rooms equipped with extra beds. Standard" or "interior" cabins have no porthole or porthole to let in daylight. Single cabins are often "standard" or "interior" cabins. Generally speaking, cabins are smaller than hotel rooms, and their classification cannot be compared with that of hotels. Suite" cabins generally feature more substantial furnishings, with a sofa serving as a lounge area. The fact of benefiting from a higher classification in a superior category cabin can only concern the accommodation in this cabin and not the services linked to the category (such as access to certain restaurants or activities, special attention, etc....). ML Private Travel's suppliers may be obliged, for reasons of safety, third-party action or force majeure, to change the hotels or boats mentioned, without this measure constituting a modification of an essential element of the trip. Wherever possible, the customer will be notified in advance and provided with a service in the same category as that initially proposed. No compensation can be claimed by the customer. The direction of circuits and auto tours may be modified, but all scheduled visits and stages are respected. Civil and religious holidays, strikes, climatic events and demonstrations in the countries visited may lead to changes in visits or excursions, for which the organizer cannot be held responsible. We invite our customers who have booked a rental vehicle through us to note on the rental contract, before picking up the vehicle and when returning it, any observations or reservations concerning the apparent condition of the rented vehicle and the full tank of fuel to avoid any subsequent dispute, and to refuse any vehicle whose condition might appear to you to be dangerous for safety.

Activities

Only the services explicitly mentioned in the trip description and booking form are included in the package. Some activities may present risks, particularly for young children. Parents of babies are advised to bring along the appropriate food for their child, which they may not always be able to find locally. They may be charged extra for heating food or feeding bottles on site.
Scuba diving requires a medical certificate of fitness less than three months old, which can be obtained from a general practitioner. In the event of any problem arising after the certificate has been issued, the client undertakes to inform the diving center, which may request a further examination and/or refuse to allow the client to dive. Refusal to dive by the diving center shall not entitle the customer to compensation. The customer must present his/her logbook and/or certificate to the dive center manager. Refusal by the dive center to allow the customer to dive shall not entitle the customer to compensation if such refusal is due to imperative safety reasons. The customer undertakes to comply with the diving center's rules and safety instructions.
In the event of non-compliance, the center manager may refuse to allow the customer to dive at the center, without compensation to the customer. Dives may be cancelled in the event of force majeure, particularly in the event of adverse weather conditions or natural disasters, without compensation to the customer.

Force Majeure

Force majeure is defined as any unforeseeable and irresistible event beyond the control of the parties, which prevents the customer, the travellers, the agency or its service providers from performing all or part of their obligations under the contract. For the duration of the event, the obligations of the parties are suspended.

Claims

Your complaints must be sent to ML Private Travel by registered post, accompanied by supporting documents, within thirty days of your return. In the event of a problem encountered on site, we ask you to contact us as soon as possible by telephone or e-mail so that we can intervene with our service provider. We also advise you to contact our service provider's representative, whose contact details appear on your travel documents. Complaints are immediately forwarded to our suppliers for investigation. Response times vary from one supplier to another, and we apologize for any delays, which are beyond our control.
